Understanding your options

The Right Claim, Built on the Right Evidence, Changes the Conversation

“When the Truth Was Hidden, the Law Doesn’t Have to Be.”

What Is Fraud and Misrepresentation?

In California, civil fraud is more than a strong feeling that you were misled — it’s a legal claim with specific elements: a false statement (or a hidden truth), knowledge that it was false, intent to deceive, your reasonable reliance on it, and real damages that followed. Misrepresentation works similarly but can apply even when the other side was negligent rather than knowingly dishonest.

Common matters include:

Business and investment fraud

Real estate misrepresentation and undisclosed defects

Fraudulent inducement into contracts and partnerships

Concealment and breach of fiduciary duty

Promissory fraud (promises made with no intent to perform)

These cases often involve overlapping claims, time-sensitive evidence, and the possibility of punitive damages — which is why early legal strategy matters more here than in most disputes.

What makes us different.

Fraud isn’t proven by feeling — it’s proven by documents, timelines, and the careful sequence of what the other side knew and when they knew it. We approach every claim by reconstructing the deal from both sides of the table, so we know exactly where the deception lives before we name it in court. Our bilingual service (English & 中文) serves individuals, families, and businesses across Los Angeles, the San Gabriel Valley, and Orange County with focus, flexibility, and the kind of methodical preparation these cases quietly demand.

Frequently asked questions

What’s the difference between fraud and just a bad deal?

Not every deal that goes wrong is fraud. California fraud requires a false statement (or hidden material fact), knowledge that it was false, intent to deceive, your reasonable reliance, and damages — all five. A souring partnership, a failed investment, or a breach of contract can be costly without rising to fraud. We’ll tell you which claim your facts actually support before you commit to a strategy.

Do I need to prove the other side intended to lie?

For intentional fraud, yes — you need to show they knew the statement was false (or were recklessly indifferent to its truth) and meant for you to rely on it. But California also recognizes negligent misrepresentation, which doesn’t require intent — only that the other party had no reasonable basis to believe what they were saying. Different claims, different burdens, different evidence.

How long do I have to file a fraud claim in California?

Generally three years from the date you discovered the fraud, not the date it happened. California’s “discovery rule” can extend that window for fraud claims, but defendants will fight to argue you should have discovered it sooner. The longer you wait, the harder that argument is to beat — talk to an attorney as soon as the pattern becomes clear.

Can I recover more than my out-of-pocket losses?

Often, yes. California allows punitive damages in fraud cases where the conduct was malicious, oppressive, or otherwise egregious, on top of your actual losses. You may also be entitled to benefit-of-the-bargain damages (what you would have received if the deal had been as promised), and sometimes attorney’s fees if a statute or contract provides. The numbers in fraud cases can be significantly higher than in routine contract disputes.

What evidence do I need to prove fraud?

Strong fraud cases are built on documentation: emails, contracts, financial statements, recorded representations, and any record of what was said versus what was true. Memory and intuition aren’t enough — but you’d be surprised how much you already have. We start by reviewing what’s in your hands before we ask the court for what isn’t.

Words From Clients

What You Lost Has a Number. What They Did Has a Name.

The hardest part of being defrauded isn’t always the money — it’s the moment you realize what actually happened. People in that moment often do one of two things: assume nothing can be done, or rush in without a plan. Neither protects you. A single consultation can tell you what your facts actually prove, what the law allows you to recover, and what your timeline looks like — before you’ve made another move.
