Restraining Orders in California: What to Expect and How We Help
When someone will not leave you alone — a neighbor, a coworker, an acquaintance, someone you barely know — the law gives you a way to set a hard boundary the court will enforce. We help you understand which order fits your situation, gather the evidence that actually persuades a judge, and stand with you in the courtroom. And if you are the one who has been served, we help you respond before a temporary order becomes a lasting mark on your record.
Civil Harassment Restraining Orders
A civil harassment restraining order, under Code of Civil Procedure section 527.6, protects you from someone you are not closely related to or dating — a neighbor, coworker, stranger, or distant relative. It can order them to stop the harassment, stay away, and have no contact with you.
Temporary Orders and the Court Hearing
Protection can start quickly. A judge can grant a temporary restraining order right away, and then a hearing is set, usually within a few weeks, where both sides are heard before a longer order is issued. We prepare your evidence and your testimony so you walk in ready.
Responding to a Restraining Order Against You
Being served is serious, and ignoring it is the worst response. An order can affect your firearm rights, your record, and where you can go. We help you answer the petition, prepare your side, and present it clearly at the hearing.

No one should have to feel unsafe in their own life. Whether you are seeking protection or defending yourself against an order, you deserve someone in your corner who stays calm, knows the law, and treats you with dignity.

What is a civil harassment restraining order in California?
It is a court order, under Code of Civil Procedure section 527.6, that protects you from harassment by someone you do not have a close family or dating relationship with — think neighbors, coworkers, acquaintances, or strangers. It can require that person to stop the behavior, stay a set distance away, and have no contact with you.
What is the difference between a civil harassment and a domestic violence restraining order?
The difference is the relationship. If the person is a spouse, ex, dating partner, co-parent, or close relative, you generally seek a domestic violence restraining order under the Domestic Violence Prevention Act (Family Code section 6200 and following). If there is no such close relationship, a civil harassment restraining order is the right tool. We help you file under the correct one, which matters for how the case proceeds.
What counts as harassment under California law?
The law looks for unlawful violence, a credible threat of violence, or a knowing and willful course of conduct that seriously alarms, annoys, or harasses you, serves no legitimate purpose, and would cause a reasonable person substantial emotional distress. A single rude encounter usually is not enough; a pattern, or a genuine threat, often is.
How fast can I get protection, and how long does it last?
A judge can issue a temporary restraining order quickly, sometimes the same or next day, to protect you until a hearing. At that hearing, usually held within a few weeks, the court decides whether to grant a longer order, which can last up to five years and may be renewed.
I have been served with a restraining order — what should I do?
Do not ignore it, and do not contact the protected person, even to explain. A restraining order can affect your firearm rights, your record, and your freedom of movement. Read it carefully, follow it exactly, and speak with an attorney right away so you can respond to the petition and present your side at the hearing.

“ I was selling my business and used Elizabeth as my attorney to complete the transaction. Elizabeth was 100% professional and even answered texts on the weekend. I am not the easiest guy to do business with, as I expect people to go above and beyond like I feel I do myself. This attitude that I have is not always appreciated? Elizabeth not only put up with my attitude, she was extremely pleasant to work with. Brian W.

Still not convinced?
Deciding whether to go to court over someone’s behavior is hard, and it is normal to second-guess yourself. But you do not have to keep tolerating threats, stalking, or harassment, and you do not have to face a court hearing alone if one has been filed against you. The first step is simply understanding your options under California law, with no pressure and no judgment.
